The PEDIGREE® Facebook page is a place for our fans to discuss the PEDIGREE® Brand, our products and our content. The following guidelines are designed to help provide a safe and positive environment for our community.

By using or accessing this page, you agree to comply with Facebook’s Terms and Conditions. Posting by fans to the PEDIGREE® Facebook page do not necessarily reflect the opinions of Mars Incorporated, PEDIGREE®.

We expect that participants post content and commentary that is both relevant and respectful to this community as a whole. PEDIGREE® reserves the right to remove any posts that don’t adhere to our guidelines and to block anyone who violates them repeatedly. Specifically, we do not tolerate these kinds of posts:

- Abusive, harassing, stalking, threatening or attacking others
- Defamatory, offensive, obscene, vulgar or depicting violence
- Hateful in language targeting race/ethnicity, religion, gender, nationality or political beliefs
- Fraudulent, deceptive, misleading or unlawful
- Trolling or deliberate disruption of discussion
- Violations of any intellectual property rights
- Spamming or repetitive in nature
- Uploading files that contain viruses or programs that could damage the operation of other people’s computers
- Commercial solicitation or solicitation of donations
- Link baiting (embedding a link in your post to draw traffic to your own site)
- No copyrighted or trademarked images or graphics. Content should be owned by the user.

By submitting your content to the PEDIGREE® Page, you grant Mars, Incorporated and its affiliates a non-exclusive, irrevocable, worldwide, perpetual right to use such content (or any idea contained in such content) in any way and in all media (now known or developed in the future) for any purpose without further approval by or payment to you. You understand and agree that any content you submit to the PEDIGREE® page is not confidential or proprietary.

We hope you will share your comments, photos, videos and other content about the PEDIGREE® Brand. When you do so, the following Submissions Terms apply. IF YOU DO NOT AGREE TO ANY OF THESE SUBMISSION TERMS, THEN PLEASE DO NOT SUBMIT YOUR CONTENT TO US.

In consideration of the opportunity to submit your comments, photos, videos or other content (“Your Content”) to the PEDIGREE® Brand Page on Facebook, you agree that:
1. You are an individual legal resident of the U.S. who is at least the age of majority or older in your state of residence (age 21 in Mississippi, age 19 in Alabama and Nebraska, and age 18 in all other states);
2. Your Content does not violate any third party’s right of privacy or publicity and does not infringe, misappropriate or violate any copyright, trademark, patent, literary, trade secret or other proprietary right;
3. You are the sole creator and owner of and have the unrestricted right to create and submit Your Content and to grant the rights to Your Content set forth below;
4. Your Content does not (a) include any commercial advertising or element (such as business names or logos, brand names, characters or slogans) other than those relating to the PEDIGREE® Brand or other products of Mars Petcare US, Inc. and its affiliates (collectively, “Mars”); (b) disparage or make unsubstantiated claims about any person or entity or its products or services; and (c) contain any virus, bug, worm or other corruptive code;
5. Mars and its designees have a worldwide, non-exclusive, sub-licensable (through multiple tiers), transferable, fully paid-up and royalty-free, perpetual, irrevocable right to use, reproduce, distribute (through multiple tiers), modify, enhance, create derivative works of, publicly perform, publicly display, digitally perform, make, have made, sell, offer for sale, export and import Your Content (including your name, likeness, voice, biographical information and other elements of your identity, if and to the extent depicted, mentioned or otherwise identified in Your Content) in any media now known or hereafter developed, for Mars’ commercial and other purposes without further approval by or payment to you;
6. Mars is the sole and exclusive owner of all right, title and interest in and to all business names, logos, brand names, characters and slogans relating to the PEDIGREE® Brand and other products of Mars, along with all goodwill associated therewith (collectively, the “Mars Intellectual Property”). Nothing in these Submission Terms constitutes authorization for you to use the Mars Intellectual Property for any purpose other than submission of Your Content;
7. Mars reserves the right, in its sole discretion, to use and not use Your Content, to remove Your Content from the PEDIGREE® Brand Facebook Page and to terminate your access to the PEDIGREE® Brand Facebook Page;
8. You are fully responsible for Your Content, including its legality, reliability, accuracy and appropriateness and understand that Mars is not responsible for any unauthorized use of Your Content by third parties. YOU AGREE TO UNCONDITIONALLY AND IRREVOCABLY RELEASE MARS AND ITS AFFILIATES FROM ANY AND ALL LIABILITIES, CLAIMS OR DAMAGES ARISING FROM OR RELATED TO YOUR CONTENT AND/OR MARS’ EXERCISE OF THE RIGHTS GRANTED HEREUNDER TO YOUR CONTENT. THE FOREGOING RELEASE DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. IF FOR ANY REASON THE FOREGOING RELEASE IS UNENFORCEABLE, THEN MARS’ MAXIMUM LIABILITY FOR ANY TYPE OF DAMAGES UNDER THESE SUBMISSION TERMS IS LIMITED TO $1,000. (If you are a California resident, you understand that the foregoing release covers all claims or possible claims of every nature and kind and all rights under Section 1542 of the Civil Code of California, which states as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”);
9. You are subject to and must comply with Facebook’s Terms & Policies and with all applicable federal, state, and local laws, rules and regulations;
10. You are solely responsible for any and all charges, fees and/or costs associated with developing and posting Your Content and agree that Mars is not responsible for technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines or for any damage to your computer or device resulting from your access to and use of the PEDIGREE® Brand Page on Facebook;
11. Mars does not endorse or otherwise support any opinion or content provided by anyone other than representatives of the PEDIGREE® Brand. All use of the PEDIGREE® Brand Page on Facebook and any content on it is at your own risk;
12. Mars will process your personal information as described in the Mars Privacy Statement;
13. Any dispute arising in connection with Your Content or these Submission Terms is governed by the internal laws of the State of Delaware and must be brought in a court of competent jurisdiction within the United States;
14. If any provision of these Submission Terms is found to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited so that the remaining provisions of these Submission Terms will continue in full force and effect; and
15. If you have a good faith belief that Your Content has been copied in a way that constitutes copyright infringement or that your intellectual property rights otherwise have been violated on or through the PEDIGREE® Brand Page on Facebook, please send your claim or notice of infringement to: DMCA Agent, c/o Marketing Properties, Mars, Incorporated, 101 International Drive, Mount Olive, NJ 07828 or DMCA@effem.com.
